User Agreement
Welcome to Kanmon’s website. This website is owned and operated by Kanmon Inc., a Delaware corporation, and its affiliates (Kanmon, we, or us). By visiting our website at www.kanmon.com, including any subdomain thereof, you acknowledge and agree to accept and adhere to the following terms and conditions as stated in this agreement (hereafter referred to as User Agreement), along with the terms and conditions as stated in our Privacy Policy.
Users means anyone who accesses or uses the Website or the Resources (defined below). We reserve the right to change or amend this User Agreement from time to time without notice. All changes shall be effective upon posting. We may terminate, suspend, change, or restrict your access to all or any part of the Website without cause, notice, or liability.
Limitations of Use and Compliance with Laws
You agree to use the Website, including the text, data, source code, software, photos, images, information, resources, services, products, tools, and other information (collectively the Resources), only for the purposes permitted by the terms and conditions of this User Agreement and applicable laws, regulations, and generally accepted online practices.
The Website and related services are intended solely for Users who are eighteen (18) years of age or older. By using the Website, you represent and warrant that you are 18 years of age or older. Engaging in any activity that disrupts or interferes with the Website or the Resources is strictly prohibited. Attempting to copy, duplicate, reproduce, sell, trade, or resell the Website or the Resources is strictly prohibited.
Permissible Purpose and Consents
By applying for a loan with Kanmon, you have provided written instructions in accordance with the Fair Credit Reporting Act (FCRA) for Kanmon to obtain your credit report and/or credit score(s) on a recurring basis. You understand and agree that Kanmon may access your credit profile, including your credit report and credit score(s), to verify your identity and use as an overlay in the credit underwriting process.
By applying for a loan, you have provided express consent to receive application tracking and/or alerts via SMS text at the number provided in your loan application.
You further understand and agree that, by applying for a loan with Kanmon, you have provided written instructions in accordance with FCRA for Kanmon to obtain and use your credit report(s) to notify you of credit opportunities and other products and services that may be available to you through Kanmon or through unaffiliated third parties. Kanmon receives compensation for the marketing of such opportunities through third parties.
If you would like a statement of specific reasons why your credit application was denied, you will contact Kanmon via email at [email protected] within 60 days of the completion of your application. We will provide you with the statement of reasons within 30 days after receiving your request.
Consent to Doing Business Electronically
Because Kanmon operates principally on the internet, you will need to consent to receive communications and transact business with us online and electronically. By accessing this Website, you certify that you understand the requirements stated herein and consent to transact business electronically.
You hereby agree that we may deliver all Communications concerning you, your business, or Kanmon electronically, including via email, posting on the Website, or other means of electronic communication.
Withdrawing Consent: You may withdraw your consent to receive Communications electronically by contacting us as described below. However, if you withdraw consent while your business has a pending loan application, we reserve the right to terminate that application. Withdrawal does not affect the legal validity of any prior transactions.
Paper Copies: You may request paper copies of any Communication by contacting us as provided below. Such requests will be provided at no charge.

Consent to be Contacted
You hereby expressly consent to be contacted by us in any way, including SMS messages, calls using prerecorded messages or artificial voice, and calls and messages delivered using automated telephone dialing systems at the telephone number provided by you. Automated messages may be played when the telephone is answered. You represent that you are the owner or authorized user of any telephone number you provide and that you are permitted to receive calls and/or messages at each such number.
Opting Out: You may revoke your consent to receive communications via text at any time by emailing [email protected].
Call Monitoring and Recording
If you contact Kanmon by phone or Kanmon contacts you by phone, you agree that we may monitor and/or record the call for purposes including quality assurance, training, risk management, and collection purposes.
Offers and Promotional Materials
Kanmon may, from time to time, offer discounted rates, reduced fees, or other promotional offers to certain Users. Unless otherwise required by law or specifically authorized in writing by Kanmon, such offers are non-transferable. Kanmon expressly prohibits the reproduction of its promotional materials unless specifically authorized in writing.
Taxation
Please be aware that borrowing money can result in unintended tax consequences for some borrowers in specific cases. Kanmon disclaims any obligation to prevent or liability caused by additional taxes, destruction of tax benefits, or tax penalties incurred due to an extension of credit from Kanmon. It is your obligation to determine potential liabilities and consult with your tax advisors.
Access to Resources
To access the Resources, you may be required to provide certain information about yourself and your business. You agree that any information you provide will be accurate, correct, and up to date. You are responsible for maintaining the confidentiality of any login information associated with any account you use to access the Resources, and accordingly, you are responsible for all activities that occur under your account.
Intellectual Property
The content of this Website, including but not limited to text, images, graphics, sound, software, and trademarks, is owned by or licensed to Kanmon and is subject to copyright, trademark, and other intellectual property rights. You may not reproduce, modify, distribute, display, perform, or use any of these materials without Kanmon’s prior written consent, except as expressly permitted by this User Agreement.

THE WEBSITE AND THE RESOURCES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. KANMON MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR FREEDOM FROM COMPUTER VIRUS.
Limitations of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KANMON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR THE RESOURCES. IN NO EVENT SHALL KANMON’S TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100).
Indemnification
You agree to indemnify and hold harmless Kanmon, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Website or the Resources, your violation of this User Agreement, or your infringement of any intellectual property or other rights of any person or entity.
Governing Law
This User Agreement and any dispute arising hereunder shall be governed by the laws of the State of California, without regard to conflict of law principles. You consent to the exclusive jurisdiction and venue of courts in San Mateo County, California, for all disputes arising out of or relating to this User Agreement.
Dispute Resolution
Any dispute arising out of or relating to this User Agreement or the Services shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
